Terms of Service
Effective: March 1, 2026
These Terms govern your use of webie.app, Webie mobile apps, NFC hardware, and related services ("Services") by Webie, Inc. ("Webie"). By using the Services, you agree to these Terms.
1. Eligibility & Accounts
You must be 13+ (16+ in EEA). Keep your credentials confidential and your info accurate. You're responsible for all activity under your account.
2. Payments
Subscriptions are billed in advance (monthly/annually) via Stripe. Cancel anytime; takes effect at end of billing cycle. No prorated refunds. NFC hardware is non-refundable once shipped, except defective items (exchange within 30 days). Custom products are final sale.
3. Your Content
You own your content. You grant Webie a non-exclusive, royalty-free license to use it solely to operate the Services. This license ends when you delete your content or account. You're responsible for ensuring your content doesn't violate laws or third-party rights.
4. Acceptable Use
Don't upload harmful or unlawful content, impersonate others, spam, scrape, interfere with the Services, or resell without consent. We may suspend accounts for violations.
5. Team Plan
Team admins can manage member cards, access analytics, and handle offboarding (deactivate cards, reassign NFC URLs). The Team Customer owns all team data; Webie is the data processor. Per-seat billing; mid-cycle additions prorated. DPA available on request.
6. NFC Hardware
NFC chips store only a URL. 90-day warranty against manufacturing defects. Does not cover misuse or normal wear.
7. IP
The Services, software, designs, and trademarks belong to Webie. These Terms grant no ownership rights.
8. Disclaimers & Liability
THE SERVICES ARE PROVIDED "AS IS." WEBIE IS NOT LIABLE FOR INDIRECT OR CONSEQUENTIAL DAMAGES. TOTAL LIABILITY IS LIMITED TO THE GREATER OF AMOUNTS PAID IN THE PRIOR 12 MONTHS OR $100.
9. Indemnification
You indemnify Webie against claims arising from your use, content, or violations of these Terms.
10. Disputes
Florida law applies. Binding arbitration (AAA, Orange County, FL). Class actions waived. Either party may seek court injunctive relief for IP matters.
11. Termination & General
Either party may terminate anytime. Sections 3, 7, 8, 9, 10 survive. These Terms plus our Privacy Policy are the entire agreement. Unenforceable provisions are severed. We may update these Terms; continued use means acceptance.
